1. Introduction and Acceptance
These Terms of Use (“Terms”) govern your access to and use of www.tawatable.com
(“Website”) and its related software, applications, APIs, and services (collectively, the “Services”) provided by Sai Tech & Infrastructure Pvt. Ltd. (“Tawatable,” “we,” “our,” or “us”).
By accessing or using Tawatable’s restaurant POS Services, you (“User,” “Restaurant,” “you,” or “your”) agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Services.

2. Eligibility
You represent and warrant that:
  • You are authorized to operate a restaurant, café, food outlet, or hospitality business;
  • You are legally capable of entering into a binding contract under the Indian Contract Act, 1872; and
  • You are not prohibited by any applicable law from using the Services.

3. Service Description
Tawatable provides a restaurant-focused Point-of-Sale (POS) and management system, including but not limited to:
  • Order and Table Management
  • Billing and Invoicing
  • Menu Configuration
  • Inventory and Stock Management
  • Digital Payments and Settlement Tracking
  • Khata / Digital Ledger
  • Customer Relationship Management (CRM)
  • Online Ordering / eStore integration
  • Reports, analytics, and operational insights
Features may vary by plan and may be updated or modified from time to time.

4. License and Permitted Use
Tawatable grants you a limited, non-exclusive, non-transferable, non-sublicensable, and revocable license to use the Services solely for managing your restaurant operations.
You may not:
  • Resell, lease, or commercially exploit the Services
  • Use the POS system for another restaurant or third party without authorization
  • Copy, modify, reverse engineer, or create derivative works
  • Extract data using bots, scrapers, or automated tools

5. Restaurant Responsibilities
You agree to:
  • Ensure all orders, bills, prices, taxes (GST), and menu data entered into the POS are accurate
  • Comply with applicable food safety, tax, and business regulations
  • Maintain confidentiality of staff logins and access controls
  • Be responsible for all transactions processed through your account
  • Immediately notify Tawatable of unauthorized access or misuse
You agree not to:
  • Use the POS system for illegal sales or prohibited items
  • Manipulate billing, reports, or tax data
  • Upload malicious software or interfere with system functionality

6. Payments, Subscriptions, and Billing
  • Use of the Tawatable Restaurant POS requires payment of applicable subscription or license fees
  • All charges are non-refundable, unless otherwise stated in writing
  • Tawatable may revise pricing, plans, or features at its discretion
  • Continued use after price changes constitutes acceptance

7. No Refund Policy
All payments made for Tawatable Services are final. No refunds, credits, or adjustments will be provided for partial usage, downtime, or early termination.

8. Data and Privacy
Restaurant data, including orders, customers, and transactions, is governed by our Privacy Policy. You retain ownership of your business data, while Tawatable may process such data solely to provide and improve the Services.

9. Intellectual Property
All software, POS interfaces, branding, reports, and system designs are the intellectual property of Tawatable or its licensors. Unauthorized use is strictly prohibited.

10. Limitation of Liability
Tawatable shall not be liable for:
  • Incorrect orders, pricing, or billing entered by restaurant staff
  • Loss of revenue due to internet outages, hardware failure, or third-party payment gateways
  • Indirect, incidental, or consequential damages, including loss of profits or business
Liability, if any, shall be limited to the amount paid by you for the Services during the preceding billing cycle.

11. Indemnification
You agree to indemnify and hold harmless Tawatable and its affiliates from any claims, penalties, losses, or damages arising from:
  • Your restaurant operations
  • Regulatory or tax non-compliance
  • Misuse of the POS system

12. Suspension and Termination
Tawatable may suspend or terminate access without notice if:
  • These Terms are violated
  • The Services are misused or abused
  • Required by law or regulatory authorities

13. Governing Law and Jurisdiction
These Terms shall be governed by the laws of India. All disputes shall fall under the exclusive jurisdiction of the courts of New Delhi, India.

14. Changes to Terms
Tawatable may update these Terms at any time. Continued use of the Restaurant POS after changes indicates acceptance.
